By installing this application, I confirm that I voluntarily and unequivocally consent to the "Kharkiv IT Cluster" Public Union (as the Database Owner) to process, including transfer to third parties, the data I have provided and to take all necessary actions, that in compliance with the Law of Ukraine "On Personal Data Protection" are the processing of my personal data, according to the purpose of their processing, namely:

In order to improve the usability of the IT Community application and take advantage of all the benefits of joining the Kharkiv IT Cluster information space, in particular in the Telegram messenger.

For the purpose of relations in the field of advertising, marketing and collection of personal data for commercial goals, relations in the field of statistics, other relations related to the processing of personal data in compliance with Article 10 of the Law of Ukraine "On Personal Data Protection" dated 01.06.2010 № 2297-VI according to the requirements of the Civil Code of Ukraine, the Commercial Code of Ukraine, the Tax Code of Ukraine, the Company's Charter, other regulatory legal acts of Ukraine and local acts of the Database Owner;

Receipt of appeals (notifications, requests, etc.) by means of telephone communication (including SMS), postal communication, e-mail;

Carrying out advertising and marketing activities of the Owner (including, but not limited to, such actions as sending informational and/or advertising messages about promotions or special offers by e-mail, sending SMS or voice messages, etc.)

1. KEY TERMS AND DEFINITIONS

1.1. The IT Community Loyalty Program (hereinafter referred to as the Program) is a comprehensive system of measures that regulates the relationship between the Organizer of the IT Community Loyalty Program, IT Community Loyalty Program Partners and IT Community Loyalty Program Members, within which the participants have an opportunity to receive promotional/special offers of the Program Partners for the purchase of goods/works/services.

1.2. The Organizer of the IT Community Loyalty Program (hereinafter referred to as the Organizer) is a legal entity that organized the Program and has exclusive rights to manage and develop the Program, as well as its authorized representatives. The Program is organized by the Kharkiv IT Cluster Public Union.

1.3. Participant of the IT Community Loyalty Program (hereinafter referred to as the Participant(s)) is a legally capable individual who is a resident of Ukraine and has reached the age of 18, has agreed to participate in the program by activating an account in the Program, unequivocally agrees to the Rules of the IT Community Loyalty Program and whose participation is confirmed by the Organizer.

1.4. The IT Community Loyalty Program Member Card (hereinafter referred to as the Member Card) is a virtual card of the IT Community Loyalty Program Member in the Organizer's information system and mobile application. The Member Card is provided to him/her exclusively through the activation of an account in the Program.

1.5. Application form of the IT Community Loyalty Program Participant (hereinafter referred to as the Application Form) is a registration form in the relevant IT Club mobile application filled in by the Participant and is a confirmation of the person's desire to become a Participant of the Program, as well as confirmation of the Participant's consent to the Rules of the IT Community Loyalty Program and consent to the storage, processing by any means and use by the Program Organizer of the Participant's personal data contained in the Application Form.

1.6. Program Partner (Partner) is a business entity, i.a. an individual entrepreneur, which, according to the terms of the Program, provides Program Participants with preferential/promotional/special offers for the purchase of goods/services or other bonuses as a reward for participation in the Program.

1.7. Loyalty Identifier is a unique number that is part of the Virtual Card on electronic media. The Loyalty Identifier is used to identify an individual as a Program Member in order to determine his/her right to receive Rewards.

1.8. Reward means preferential/promotional/special conditions for the purchase/receipt of goods/services/works or other form of bonus to the Program Participant, issued by the Partner in agreement with the Organizer in accordance with the provisions of these Rules and the current legislation of Ukraine. Receipt of Reward under the Program means a bonus/gift/purchase of the above-mentioned benefits by the Participant at a preferential/promotional/special price (with a discount from the existing prices, which is provided in compliance with the procedure established by these Rules) following the terms and conditions of the Program and the current legislation of Ukraine.

1.9. Program Hotline is a service provided by the Organizer to Program Participants in order to resolve issues related to participation in the Program. The contact details of the Program Hotline are set out by phone 380506588846, as well as in the Program mobile application and within the Program Participant's package.

2. GENERAL PROVISIONS

2.1. The Program is an adhesion agreement as defined in Article 634 of the Civil Code of Ukraine.

2.2. The program is not a game of chance, lottery, or gambling service.

2.3. The Program is valid at all sale points (centers/representations) of the Program Partners (information on the addresses of the Partners is available in the "IT Community" mobile application of the Loyalty Program).

2.4. Organizer has the right to stop the Program, cancel or change the terms of the Program.

3. PROGRAM PARTICIPATION AND REGISTRATION RULES

3.1. Only an adult individual who is an employee/contractor or subcontractor of a Kharkiv IT Cluster member company, has correctly filled in the required fields of the Application Form and agreed to the terms of the IT Community Loyalty Program Rules, can participate in the Program.

3.2. By filling out the Program Participant Application Form, an individual submits personal and contact information for registration in the mobile application of the Program. Completion and submission of the Application Form data to the information system is a mandatory condition for rightful participation in the Program. Each Application Form contains required fields marked with asterisks. Without submitting the information in the required fields of the Application Form the registration of a Participant in the Program is impossible.

The Application form filled in and validated by an individual certifies his/her voluntary consent (permission) to the Program Organizer to process (collect, register, accumulate, store, adapt, change, update, use, distribute (disseminate, sell, transfer), depersonalize, destroy, etc. including using information (automated) systems) personal data of an individual and other data specified in this Application form in order to personify an individual as a Program Participant, in particular for participation in all promotions and advertising activities as well as consent to the transfer (dissemination) of his/her personal data to the Program Partners and third parties (including personal data managers, foreign subjects of relations associated to personal data) for the purpose of their processing, personal communication with the Participant, transfer and receipt of information. The Program Participant may refuse to receive such information at any time by notifying the Organizer through the hotline or via digital communication channels provided by the Organizer. By filling out and submitting the Application Form, an individual certifies that he/she is familiar with these Program Rules and aware that the personal data provided by him/her is entered into the information system - the Database of Program Participants' personal data, and confirms that he/she is familiar with the rights granted to him/her as a personal data subject in accordance with Article 8 of the Law of Ukraine "On Personal Data Protection" and the provisions of the current legislation. The application form does not contain any identification data of the individual, such as passport numbers and identification code. The Application Form filled in and validated by an individual also certifies his/her agreement with all the conditions and these Program Rules.

3.4. The Participant undertakes to provide accurate and reliable data when filling out the Application Form and to notify the Organizer in a timely manner of any changes regarding the information provided. The Program Participant is responsible for the accuracy and relevance of the data specified in the Application Form, as well as for timely notification of the changes. The Program Organizer is not obliged to verify the accuracy of the information provided in the Application Form.

3.5. The Participant's data specified in the Application Form is confidential. Access to the data may be granted to the responsible persons of the Organizer and the Participant and other persons, including Partners, who have been granted access to the data on legal basis. This data may also be provided at the request of law enforcement and/or other authorities in accordance with the applicable law.

3.6. The Organizer undertakes to properly collect, store, process the data of the Program Participants and use it within the boundaries of the Program and these Rules.

3.7. The Program Participant has the right to register only one Member Card for himself/herself. In case the Participant has several Member Cards, the Program Organizer reserves the right to deactivate all the cards of such Participant and leave only one.

3.8. The Program is intended for personal use only by individuals - Program Participants, and the rights of the Program Participant cannot be transferred, sold, monetarily compensated or alienated in any other way.

3.9. The Participant has the right to terminate his participation in the program, delete the account by sending a message using the contact form. As soon as the Program Organizer receives this notification, the Participant's membership in the Program will be terminated and the Participant's Member Card will be blocked.

3.10. The Program Organizer reserves the right to suspend or terminate the participation in the Program of any Program Participant without prior notice by blocking the Participant's Member Card in cases where the Participant:

4. CONDITIONS FOR PARTNERS TO PARTICIPATE IN THE PROGRAM

4.1. The Program Partners are legal entities registered under the laws of Ukraine and individual entrepreneurs conducting business activities in Ukraine according to the current legislation of Ukraine.

4.2. The Partners who have confirmed their participation in the Program in the manner prescribed by these Terms and Conditions and have undertaken to comply with them have to provide a preferential/promotional/special offer in the form of a discount/bonus/gift that is agreed with the Organizer. A sample of the Partner registration form is approved by the Organizer and placed in the public domain on the relevant Program website.

4.3. According to these Rules, in order to participate in the Program, the Partner is obliged to:

In case of changes in the conditions of the above terms of participation in the Program, the Partner is obliged to send a request to the Organizer to the e-mail address info@it-kharkiv.com 05 working days before the desired moment of implementation of such changes. The Organizer, in case of approval of such changes, adds them to the Partner's information in the Program mobile application within five business days, or, in case of disagreement, refuses to make such changes to the Partner.

4.7. The Partner is fully responsible for providing the Organizer with the logo/brand for positioning in the Program, as well as for the list of goods/works/services and their quality.

5. OTHER CONDITIONS

5.1. The Program Organizer, at its sole discretion, has the right to make any changes to the current Terms and Conditions of the IT Community Loyalty Program at any time, and notify the Program Members by posting the relevant information on the Organizer's website. It is the responsibility of the Participant to monitor changes in the Terms and Conditions of the IT Community Loyalty Program.

5.2. The Program Organizer is not responsible for the quality of goods, works and services sold (provided, performed) by the Program Partners.

5.3. In order to resolve disputes the Participant must contact the Organizer and provide all details of the transaction - date, description of the transaction, requisites of the Program Partner. The Organizer reserves the right to respond to the Participant's request within 30 days.

5.4. The program is long-term.

Personal data base:
Database containing personal data of IT Community loyalty Program participants.
Categories of personal data processed:
Last name, first name, e-mail address and other information about the person reflected in the Application Form or provided by the person voluntarily. The Application Form does not contain identification data of an individual, including passport numbers and identification codes.
Purpose of personal data processing:
Personification of an individual as a Program Participant for participation in all promotions and events of an advertising character.
Actions to process personal data that the Personal Data Owner is entitled to perform:
Collect, register, accumulate, store, adapt, change, update, use, disseminate, depersonalize, destroy, etc. This includes transferring (disseminating) personal data to the Program Partners, personal data managers, third parties, foreign subjects of relations associated with personal data, which the Contractor determines independently, for the purpose of processing them, including for personal communications with the Participant, transferring and receiving information. The Participant agrees that the Personal Data Owner is not obliged to notify the Participant of the actions taken to process the Participant's personal data in accordance with the purpose and objectives of their processing.
Personal data may be processed in file cabinets and/or through an information and telecommunication system.
Informing about the rights of the personal data subject:
By providing his/her personal data by filling in the Application Form, the person thereby confirms that he/she is aware that the personal data provided by him/her is entered into the information system - the Database of personal data of the IT Community Loyalty Program participants, and also confirms that he/she is familiar with the rights that are granted to him/her as a subject of personal data according to Article 8 of the Law of Ukraine "On Protection of Personal Data" and provisions of the current legislation.The Participant undertakes to provide accurate and reliable data when filling out the Application Form, as well as to notify the Personal Data Owner in a timely manner of any changes regarding the information provided.
The period of time for which consent (permission) to process personal data is granted:
The consent (permission) to process personal data is granted to the Personal Data Owner for an indefinite period, namely for the period (term) of the IT Community Loyalty Program, which the person becomes a member of.
Warning:
Non-consent of a person to the processing of his/her personal data under the above conditions, or withdrawal of the consent granted by the person, makes it impossible for him/her to register and further participate in the IT Community Loyalty Program.
